Terms of Service
These Terms of Service (“Terms”) govern your access to and use of rushcanna.com (the “Site”) and any online ordering offered through it. The Site is operated by RUSH Cannabis (“RUSH,” “we,” “us,” or “our”), a brand of licensed adult-use cannabis retailers in Hazel Park, Saline, and Oxford, Michigan. By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Age requirement — 21 and over
You must be at least 21 years of age to use the Site, place an order, or purchase any product from RUSH. By using the Site you represent that you are 21 or older and will present valid, government-issued photo identification at pickup or delivery. We may refuse service to anyone who cannot verify their age or who appears to be intoxicated.
2. Eligibility
Products are sold only to adults 21 and older for personal, recreational use within the State of Michigan, in accordance with the Michigan Regulation and Taxation of Marihuana Act and the rules of the Michigan Cannabis Regulatory Agency (“CRA”). You agree to comply with all applicable laws when using the Site and our products.
3. The service
The Site provides store information and lets you browse menus and place online reservations for in-store pickup or, where available, delivery. Online ordering is powered by Dutchie. Placing an online order is a request to reserve products; a sale is final only when completed in person at the store (or at delivery) after age verification and payment. Product availability, potency, and pricing are determined at the store at the time of the transaction.
4. Pricing, availability, and errors
Prices, taxes, discounts, and product availability may change at any time and may differ between our stores. We make every effort to display accurate information, but we do not warrant that menus, prices, descriptions, or availability are error-free, and we reserve the right to correct errors, limit quantities, and cancel or refuse any order at our discretion.
5. Payment
We accept cash and debit cards, and an ATM is available in-store. We do not accept credit cards, because federal banking rules prohibit credit-card processing for cannabis transactions industry-wide. All applicable Michigan and local cannabis taxes will be added at checkout.
6. Pickup and delivery
For in-store pickup, you must bring valid government-issued photo ID showing you are 21 or older; orders not picked up within the store’s holding window may be cancelled and restocked. Where delivery is offered, delivery is limited to eligible areas and times, an adult 21+ with valid ID must be present to receive the order, and additional delivery terms and fees may apply.
7. Returns and refunds
Due to state regulations, all cannabis product sales are final — no returns or exchanges on cannabis products. Defective non-cannabis accessories may be exchanged in-store within 14 days of purchase with a valid receipt, subject to store policy.
8. No medical claims
RUSH is a licensed adult-use (recreational) retailer. We do not make, and nothing on the Site should be interpreted as, any health, medical, or therapeutic claim about cannabis products. Cannabis is for use only by adults 21 and older and may impair judgment and coordination. Consult a licensed healthcare professional with any health questions, and do not drive or operate machinery while under the influence.
9. Acceptable use
You agree not to: purchase or attempt to purchase on behalf of anyone under 21; resell or divert any product; use the Site for any unlawful purpose; interfere with or disrupt the Site; attempt to gain unauthorized access; or scrape, copy, or harvest content or data from the Site without our written permission.
10. Intellectual property
The Site and its content — including the RUSH name, logos, text, graphics, photography, and design — are owned by RUSH or its licensors and are protected by intellectual-property laws. You may not use them without our prior written permission.
11. Third-party services
Online menus, ordering, and checkout are provided through Dutchie, and some pages may rely on other third-party services. Your use of those services is also governed by the third party’s terms and privacy policies. We are not responsible for third-party services.
12. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
13. Limitation of liability
To the fullest extent permitted by law, RUSH and its operating entities, owners, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed the amount you paid, if any, for the order at issue.
14. Indemnification
You agree to indemnify and hold harmless RUSH and its operating entities, owners, and employees from any claims, damages, or expenses arising out of your misuse of the Site or violation of these Terms or applicable law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. You agree that any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms on the Site. Your continued use of the Site after changes take effect means you accept the updated Terms.
17. Licensing and contact
RUSH Cannabis operates licensed cannabis retail establishments in Michigan. Each store is operated under its own state license:
